These terms govern your use of risegm.com, operated by Rise LLC ("Rise", "we", "us"). By using the site you agree to them. If you don't agree, don't use the site.

What this site is

risegm.com is an informational site about our agency and how we work. Everything on it, including case studies, benchmarks, pricing ranges, and articles, is provided for general information only. It isn't marketing, legal, financial, or professional advice for your situation. Nothing on this site is an offer, a commitment, a recommendation, or a guarantee of any result, and nothing on it creates a professional or advisory relationship of any kind.

Results we describe came from specific accounts under specific conditions. Your account is not those accounts. Past performance is history. It doesn't predict what yours will do.

Any decision you make on the basis of anything you read here is yours alone, and you're solely responsible for its consequences. We may change, suspend, remove, or discontinue any part of this site or anything on it at any time, without notice, and without liability to you.

Applications and client engagements

Submitting the application form starts a conversation and nothing more. It doesn't create a client relationship, doesn't obligate either of us to anything, and doesn't entitle you to a response. We may decline, ignore, or discard any application for any reason or no reason.

If we do work together, that work is governed exclusively by the signed master services agreement and statement of work between us. Where those documents and these terms conflict, the signed agreement controls for everything relating to the engagement. These terms continue to govern your use of this website.

Don't send confidential information through this site or by unsolicited email. Until a signed confidentiality agreement is in place, nothing you send us is confidential and we have no obligation to treat it as confidential.

Our content

The site and its contents, including text, design, graphics, logos, diagrams, frameworks, and the Rise name and marks, are owned by Rise LLC or our licensors and are protected by intellectual property law. All rights are reserved.

You may view the site in a browser for your own reference. No other right or license is granted, whether express, implied, or by estoppel. Without our prior written permission you may not copy, reproduce, republish, distribute, adapt, translate, resell, or create derivative works from any part of the site, and you may not use any part of it to train, fine-tune, ground, or evaluate a machine learning model.

Anything you send us

If you send us ideas, suggestions, feedback, questions, or other material about our business, our content, or our systems, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it for any purpose, without restriction, attribution, or compensation to you. Don't send us anything you expect to be paid for or want to keep.

Free skills and downloadable materials

Some materials we publish, including the skills distributed through our public GitHub repository, are made available under the license included with those materials. That license governs what you may do with them and controls over this section if the two differ. We may change, withdraw, or stop distributing any of them at any time, without notice.

Those materials are provided as-is and as-available, with no warranty, no support, and no undertaking to maintain, update, or correct them. They run on your machine, in your accounts, against your data, under your control. You're solely responsible for reviewing what they do before you run them, for the costs any third-party service charges you, and for anything they change, delete, or expose in your systems. We're not responsible for any outcome of your use of them.

Acceptable use

• Don't interfere with the site, its security, or its availability
• Don't scrape, crawl, or harvest at a volume that burdens the site
• Don't submit false information or someone else's personal information through our forms
• Don't use the site to send unsolicited commercial messages to us or anyone else
• Don't use the site for anything unlawful, infringing, or deceptive

We may suspend, restrict, or terminate your access to the site at any time, for any reason or no reason, without notice and without liability to you.

Links to other sites

We link to third-party sites and services. We don't control them, we don't endorse them, and we're not responsible for their content, their products, their availability, or their privacy practices. Following a link is your decision and your risk.

Disclaimer

The site and everything on it is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement, and any warranty arising from course of dealing or usage of trade. We don't warrant that the site will be available, uninterrupted, timely, secure, or error-free, that any defect will be corrected, or that any information on the site is accurate, complete, or current. We have no obligation to update anything on it.

Limitation of liability

To the fullest extent permitted by law, Rise LLC and its members, managers, employees, contractors, and agents won't be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost revenue, lost business, lost data, or business interruption, arising out of or relating to the site, any materials you obtain through it, or your reliance on either, whether the claim is based in contract, tort, strict liability, statute, or any other theory, and even if we've been advised that such damages are possible.

Our total aggregate liability for all claims relating to the site and its free materials will not exceed one hundred US dollars ($100). This limit applies even if a limited remedy is found to have failed its essential purpose. Some jurisdictions don't allow certain exclusions or limitations, so parts of this section may not apply to you, and in that case our liability is limited to the greatest extent permitted by law. Liability arising from a signed client engagement is governed by that agreement instead.

Time limit on claims

Any claim or cause of action arising out of or relating to the site or its free materials must be filed within one year after it arises. After that it's permanently barred, to the extent the law allows a shortened period.

Indemnification

You agree to defend, indemnify, and hold harmless Rise LLC and its members, managers, employees, contractors, and agents from any claim, demand, loss, liability, damage, or expense, including reasonable attorneys' fees, arising out of your use of the site or any materials you obtain through it, your violation of these terms, or your violation of any law or third-party right.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Before filing anything, the parties will attempt in good faith to resolve the dispute through mediation administered by JAMS in Los Angeles County, California. Any dispute not resolved in mediation will be settled by binding arbitration administered by JAMS in Los Angeles County under its applicable rules, and judgment on the award may be entered in any court with jurisdiction. The prevailing party is entitled to recover its reasonable attorneys' fees and costs.

Claims must be brought individually. Neither party may bring a claim as a plaintiff or class member in a class, collective, consolidated, or representative proceeding, and the arbitrator may not consolidate claims or preside over any form of representative proceeding. Either party may still seek injunctive relief in court to protect intellectual property or confidential information.

Changes to these terms

We may change these terms at any time. When we do, we'll change the "last updated" date at the top of the page. Changes take effect when posted, and continuing to use the site after that means you accept them. Checking this page is your responsibility.

General

You haven't relied on any statement, representation, warranty, or promise that isn't written in these terms, and you waive any claim based on reliance of that kind. If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary and the rest stays in full effect. Our not enforcing a provision isn't a waiver of it or of any other provision. You may not assign these terms. We may assign them freely. There are no third-party beneficiaries. The disclaimer, limitation of liability, time limit on claims, indemnification, content, and dispute sections survive any termination of your access. These terms, together with our privacy policy, are the entire agreement between us regarding the site.
